Go2Hire – Terms and Conditions for Digital Services
1. Introduction
These Terms and Conditions (“Agreement”) govern the provision of digital services, including but not limited to software products, development, customization, and related services (“Services”) provided by Go2Hire (“We”, “Us”, “Our”) to the customer (“You”, “Client”). By engaging in any of Go2Hire’s services, you agree to these terms.
2. Software Product Responsibility
The buyer is solely responsible for ensuring that the digital product delivered by Go2Hire is compatible with the specific environment, operating system (OS), or framework in which it will be deployed. You are also responsible for ensuring that all relevant systems are properly maintained, including updates to the OS, framework, and software components necessary for the functioning of the product.
3. Upgrades, Patches, and Security
- Client Responsibility: You acknowledge that maintaining the security and functionality of your digital product is your responsibility. This includes, but is not limited to, updating your operating system, software frameworks, and applying security patches.
- Go2Hire’s Role: Go2Hire manages upgrades, patches, and security updates only for clients under a valid contract that specifies such services. If you are not under contract for ongoing patch management, you are responsible for ensuring your product is up to date and secure.
- Chargeable Services: Any patch, upgrade, or issue fix requests after the delivery of the digital product, unless covered by a specific service contract, will incur additional charges. These services are outside the scope of the original agreement and will be billed separately.
4. No Refunds or Claims
- Refund Policy: By agreeing to these terms, you acknowledge that no refunds will be provided for digital products or services delivered by Go2Hire. The nature of digital services means that once delivered, the product cannot be returned or refunded.
- No Claims for Delivered Work: After the delivery of the product, no claims for refunds, replacements, or other financial remedies will be allowed unless there is a clear breach of contract under the specific terms of a service agreement.
5. Monitoring and Support for AMIC Projects
- AMIC Monitoring: For projects delivered under the AMIC (Advanced Monitoring and Integrated Contract) framework, Go2Hire will monitor the digital product for security patches, upgrades, and functionality. This is a separate agreement that requires a specific contract annex for continuous monitoring, security updates, and related support services. If your project is under AMIC, Go2Hire will handle monitoring and patching as agreed in the contract.
- Additional Charges: AMIC services are chargeable and are only applicable to projects that are under the AMIC contract. All other projects will be outside the scope of these services unless explicitly included in a separate agreement.
6. Risk and Liability
- Risk Acknowledgment: You acknowledge that while Go2Hire makes every effort to deliver high-quality, secure, and functional products, the use of the digital product is at your own risk. You agree to assume all risks associated with the deployment and ongoing operation of the software, including risks arising from any failure to maintain updates or address vulnerabilities.
- No Penalties for Go2Hire: Go2Hire will not be liable for any damages, losses, or penalties arising from issues such as security breaches, software incompatibility, system downtime, or failure to perform due to issues related to the environment in which the software is deployed (e.g., OS, third-party software conflicts, or hardware limitations). No penalties, fines, or claims for damages will be directed towards Go2Hire for such issues.
7. Payment Policy & Compliance with Local Laws
- Payment Policy: You agree to adhere to Go2Hire’s payment terms outlined in the service contract or invoice. Payments for services, products, and additional chargeable services are due on the specified dates, and failure to pay on time may result in suspension or termination of services.
- Compliance with Legal Norms: You are responsible for ensuring that all payments for services, as well as the engagement in any transaction, comply with the legal requirements and financial norms of the country in which you are operating. This includes abiding by local taxation laws, currency regulations, and international financial transaction protocols.
- Security Compliance: You are required to ensure that your business and its systems comply with the relevant security regulations, standards, and laws applicable to your jurisdiction. This includes data protection laws, secure payment processing, and ensuring that all transactions are conducted securely.
8. Communication and Marketing
- Opt-in Communication: By filling out a form, submitting information, or partially agreeing to Go2Hire’s services, you consent to being contacted by Go2Hire regarding product information, service updates, and other relevant offerings. This communication may include but is not limited to email newsletters, product updates, offers, and promotional material about Go2Hire’s services.
- Marketing Communications: You may receive targeted communications based on the services you have shown interest in, as per your submission or inquiry. These communications are aimed at providing you with valuable insights, promotions, or information that might benefit your business.
9. Additional Terms and Contracts
- Contractual Addendums: Specific services such as ongoing patch management, security updates, and bug fixes may require separate contracts or addendums. These will be outlined in additional contractual documents, which must be signed by both parties.
- Special Contracts for Ongoing Support: For clients seeking continuous support or periodic updates, a special contract annex may be required. This annex will outline the scope of services, service levels, payment terms, and other critical elements.
10. Governing Law
These Terms and Conditions are governed by the laws of the jurisdiction in which Go2Hire operates. Any disputes arising from the use of services or these terms shall be subject to the exclusive jurisdiction of the courts of the relevant jurisdiction.
11. Amendments and Modifications
Go2Hire reserves the right to amend or modify these Terms and Conditions at any time. Any changes will be communicated to clients, and continued use of our services will indicate your acceptance of the updated terms.
